Defendants appeal the denial of their second amended post-conviction petition without an evidentiary hearing.

After a jury trial, during which they were represented by privately retained counsel, defendants were found guilty of rape (Ill. Rev. Stat. 1963, ch. 38, par. 11-1) and each was sentenced to a term of 40 to 60 years. The public defender was appointed to represent them...
