Defendant-appellant, Ollie Willis, was convicted by jury verdict on July 18, 1973, of breaking and entering an occupied dwelling with intent to commit larceny, MCLA 750.110; MSA 28.305. He was sentenced on August 13, 1973, to a term of from two to ten years in prison and appeals by right.
