Defendant was convicted of breaking and entering, in violation of N.J.S.A. 2A:94-1; armed robbery, in contravention of N.J.S.A. 2A:141-1 and N.J.S.A. 2A:151-5, and assault with intent to rob, contrary to N.J.S.A. 2A:90-2. On defendant's motion the trial judge merged for sentencing purposes the assault with intent to rob conviction with that for robbery.
