Appellants, Marcus L. Witt, Jr., Joe Witt and Marcus L. Witt III1 were convicted by a jury of conspiracy to defraud the estate of Pearle P. Zalud and named legatees and devisees in violation of Penal Code section 182, subdivision 4.2 The trial started on October 23, 1973, and ended November 28, 1973.
