This is an appeal from an order of the Supreme Court at Special Term, entered November 8, 1974 in Schenectady County, which denied defendant's motion to dismiss the complaint pursuant to CPLR 3211 on the grounds that the court has no jurisdiction of the subject of the action, the complaint fails to state a cause of action and the court does not have jurisdiction over the person of defendant.
