MOORE, Circuit Judge:

Following a jury verdict for plaintiff-appellant in the amount of $10,000 for conscious pain and suffering and $69,500 for wrongful death (of which $2,500 represented funeral expenses), defendants Roberta and Rudolph Bentz timely moved the trial court alternatively for judgment n. o. v. and a new trial pursuant to F.R.Civ.P. 50(b) and 59 respectively. This was the second trial in the case; the first trial ended in a jury verdict for defendants...
