On December 27, 1967, the appellee, Donald Farrao, was involved in an accident. Appellee, a state employee, was on his way home from work driving a state car when the accident occurred. Appellee had insurance on his personal car, but such policy did not cover his driving a state car home from work. The state of Ohio did not insure the vehicle for such a contingency.

The state refused to defend appellee in the lawsuit which resulted in a judgment...
