This matter comes before the Court on plaintiff-appellee's "Motion To Dismiss" this appeal for the reason that defendant-appellant's notice of appeal was untimely filed. Defendant has responded to this motion by filing an affidavit, supplemental affidavit, and brief opposing dismissal of this action. For the reasons set forth below, we deny the motion to dismiss.1
