Plaintiff initiated this action to obtain damages and injunctive relief for the flooding of his property situated in Layton, Utah. In his complaint, plaintiff alleged that he had filed a verified claim with defendant on July 26, 1973, and that part of the damages he had sustained were incurred within 90 days immediately preceding the filing of his claim.
