The defendant, Andres Roman, was indicted, 73 Cr. 977, and charged in one count with possession with intent to distribute narcotic drug controlled substances, 21 U.S.C. §§ 812, 841(a)(1) & 841(b)(1). Roman waived a jury and I began the trial on November 11, 1974.
