OPINION

BUSSEY, Judge:

Appellants Frank Lewis Matthews and Virgil M. Phillips, hereinafter referred to as defendants, were charged, tried and convicted in the District Court, Woods County, Case No. CRF-74-1, for the offense of Burglary, Second Degree, in violation of 21 O.S., § 1435. Their punishment was fixed at five (5) years imprisonment and from said judgment and sentence a timely appeal has been perfected...
