This appeal arises out of the denial by the City Council of the City of North Pole of appellants' declaration of candidacy for City Council positions. On October 15, 1973, appellants Miller and Jenkins tendered their declarations of candidacy, along with the $5.00 filing fee, to the North Pole City Clerk who accepted the tender. The declarations were then taken to the City Council, and in a special pre-election meeting held on October 17, 1973...
