The defendant was convicted in a nonjury trial of delivering marijuana to a person under 18 years of age and more than five years defendant's junior, contrary to MCLA 335.346(1); MSA 18.1070(46)(1) and MCLA 335.341(1)(c); MSA 18.1070(41)(1)(c). On September 17, 1973, defendant received a sentence of 2-1/2 to 8 years in prison, and appeals.
