PATTERSON, Justice:

This is an appeal from the Chancery Court of the First Judicial District of Yalobusha County. There Mrs. Catherine F. Kerby, hereinafter Mrs. Kerby, filed a partition suit seeking the sale of property which she alleged was owned by Sidney E. Perkins, hereinafter Perkins, and herself as tenants by the entirety. Perkins in his answer denied the existence of an estate by the entirety and filed a cross bill to quiet title to the property in himself...
