On January 21, 1974, Cecil Fugate filed an application for adjustment of claim with the Workmen's Compensation Board. The claim alleged that Fugate became affected with the occupational disease of pneumoconiosis on January 11, 1974, when he was last exposed to the hazards of the occupational disease of pneumoconiosis.
