This medical malpractice action was instituted by Royce Glen French against Dr. A. E. Brodsky who had performed three disc operations on French in October, 1967, June, 1968 and November, 1968. At the trial Mr. French complained that Dr. Brodsky had failed to accurately diagnose and remove a herniated disc between the third and fourth lumbar vertebrae on the occasion of the second and third surgeries.
