This suit involves an accident which occurred when a motor vehicle ran into a winch cable stretched across the highway.

The undisputed facts are essentially as follows. On January 3, 1974, Green, the defendant, was driving his 1972 American Motors Jeep on Louisiana Highway 175 about 5 miles north of Mansfield, Louisiana, and saw an unattended pickup truck mired in the ditch.
