The plaintiff-appellee, Julius F. Ferina, moves to dismiss the appeal of the defendant-appellant, Edward Howard.

The pertinent facts, briefly stated, are as follows: Formal judgment was rendered in this matter on February 17, 1975, and on February 21, 1975 the defendant-appellant, Edward Howard, filed a motion for a new trial, which motion was heard and denied
