MEMORANDUM OPINION

This case was tried to the Court without a jury on February 22nd, 1973, before District Judge William N. Goodwin, sitting by designation in this district.

At the close of plaintiff's case in chief, Judge Goodwin granted Sheriff Lamb's and the International Hotel's motions for involuntary dismissal under Rule 41(b), F.R.C.P. At the close of all of the evidence, Judge Goodwin orally made his findings...
