James Sample was convicted of manslaughter and sentenced to a term of fifteen years in the State Penitentiary by the Circuit Court of Holmes County.

Sample assigns eight errors which he contends require reversal of his conviction. Two assignments of error are combined and we will discuss only two additional assignments of error.
