Plaintiff brought this suit on an agreement under which defendant, Dearie, a real estate broker, in order to induce decedent, John A. De Grey, to make a real estate purchase, guaranteed that De Grey would realize a profit of $10,000 within ninety days of the sale. The agreement pledged certain commissions due Dearie by defendant Malone as security for the $10,000. From a dismissal of her suit plaintiff has appealed.
