The controversy in this case arises out of condemnation proceeding instituted by the Department of Highways against landowner Della Gaylord.

The issue to be decided is whether a covenant in a prior deed to the state, of a portion of Mrs. Gaylord's land, whereby the state agreed to connect landowner's remaining property to a frontage road, requires the state to give value for the remaining tract higher...
