The state appeals an order dismissing an information which charged appellee with carrying a concealed firearm, in violation of Fla. Stat. § 790.01(2).

From the motion to dismiss and the state's traverse, it was established that the police found a .38 caliber revolver under the front seat of appellee's vehicle. The revolver was in a holster with a leather strap snapped over the hammer. By stipulation of the parties, the trial court examined...
