The defendant Flores was convicted of attempted aggravated rape, La.R.S. 14:27, 42, and sentenced to twenty years at hard labor.

The two principal assignments of error are both based on Flores' mental incapacity. Because of this incapacity, it is contended that Flores could neither assist his counsel in his defense nor have made an informed waiver of his right to remain silent during police interrogation.
