BISSETT, Justice.

This is a wrongful death action. Helen G. Morsch, the surviving wife of Jean P. Morsch, sued Laura Lynn Metzger, a minor, for the wrongful death of her husband, the said Jean P. Morsch. She alleged that her husband, while walking on a sidewalk, was struck and killed by an automobile which was backed out of a driveway by defendant. Trial was to a jury.
