The plaintiff (appellee here) brought suit seeking to recover damages for personal injuries and property damage which he alleged resulted from the defendant's negligence in driving a vehicle into the plaintiff's vehicle. Trial was held before a jury and resulted in a verdict in favor of the plaintiff and against the defendant in the sum of $5,000. The defendant filed a motion for a new trial which as subsequently amended was overruled by the trial...
