The plaintiff, First Vermont Bank and Trust Company, brought suit against defendants Maine Bonding and Casualty Company and the Village of Poultney in the Rutland Superior Court seeking to recover monies which it had loaned to a construction company in consideration of an assignment of any and all monies due it from the Village of Poultney.
