Appellant was convicted of the murder of C. W. Higginbotham and sentenced to life imprisonment.

On November 21, 1974, Jimmy Bunn heard there had been trouble at the residence of his in-laws, Mr. and Mrs. C. W. Higginbotham. Around 11:00 P.M. he went to their store-home combination in the Adger Community of Jefferson County. Noticing the lights out and the doors locked, he called the authorities.
