No. 7429SC930.

211 S.E.2d 851 (1975)

24 N.C. App. 694

STATE of North Carolina v. Curtis SIMPSON, Jr.

Court of Appeals of North Carolina.

February 19, 1975.

Attorney(s) appearing for the Case

Atty. Gen. Rufus L. Edmisten by Associate Atty. Gen. Robert P. Gruber, Raleigh, for the State.

Robert W. Wolf, Forest City, for the defendant.

BROCK, Chief Judge.

Defendant's motions for judgment as of nonsuit were properly overruled.

We have carefully considered defendant's assignments of error to the judge's instructions to the jury. In our opinion the instructions, considered as a whole, fairly presented the case to the jury under applicable principles of law.

No error.
