Burch and his wife, appealed from an order of a district court in Bexar County denying their application for a temporary injunction to restrain further proceedings in a condemnation suit which has been brought by the City of San Antonio, acting through its Water Works Board of Trustees, that sought to obtain the fee simple title to land owned by the plaintiffs.
