JACOBSON, Presiding Judge.

On May 24, 1974 appellant Jimmy Pena was arrested without a warrant for possession of narcotic drugs. On May 25 the defendant appeared for his initial hearing and a complaint was subscribed and sworn to before a court commissioner by a Phoenix police officer. At this time, the preliminary hearing was set for May 31. Bond was set as $1,100 and appellant signed the standard release order. On May 31, the defendant and his counsel...
