Cecil Pendleton, an infant proceeding by next friend, brought this action in the Fayette Circuit Court to pursue certain assets, including real estate located in Fayette County, theretofore disposed of by the administrator and apparent heirs and distributees of Cornelius Pendleton, who had died intestate a resident of Garrard County.
