FOGLEMAN, Justice.

Benny West was charged with first degree murder and held without bail from November 7, 1970 to April 1972, at which time bail was set at $50,000. Bail was reduced to $25,000 in July 1972, and on August 3, 1972, he was released on bail. A jury found him guilty of second degree murder on June 5, 1973, and he was sentenced to 21 years. On January 14, 1974, he filed a motion for modification of his sentence by crediting him with his pretrial confinement...
