ERWIN, Justice.

On October 19, 1973 appellant, Robert Donlun, was indicted1 for the offense of burglary in a dwelling in violation of AS 11.20.080.2 He pleaded not guilty and was tried before a jury in the superior court in the latter part of January, 1974.
