The plaintiff filed a motion to dismiss this appeal on the grounds that defendant had no right of appeal from the denial of the motion for summary of judgment. While there is generally no right of appeal in such cases, G.S. § 1-277(b) does give the defendant the right to appeal the judge's ruling as to jurisdiction over the defendant.
