FITZGERALD, Justice.

Shortly after midnight on January 29, 1973, Arthur Charlie, Walter Galauska and Roger Peter left Fairbanks in Galauska's pickup truck driving the Steese Highway toward Chatanika. After passing Milepost 27, the vehicle was stopped on the roadway and all three men got out. Immediately thereafter Arthur Charlie was struck on the head with a rifle and knocked to the ground.
