OPINION

JOSLIN, Justice.

This civil action for damages sustained as a result of the defendant's alleged negligence was reached for trial before a judge and jury in the Superior Court on October 8, 1971. At the conclusion of testimony the trial justice reserved decision on the defendant's motion for a directed verdict and submitted the case to the jury. On October 12, 1971, the jury returned a plaintiff's verdict of $26,000. Two days later the reserved motion...
