This action arises out of a peculiar accident occurring August 26, 1971, on a bridge in Labette County. In her petition the plaintiff, Katherine A. Kirk, nee Bachman, seeks to recover damages in the amount of $50,000 for personal injuries. The jury, in its wisdom, returned a verdict for $45,000. The defendant, Beachner Construction Company, Inc., sometimes referred to as Beachner, has appealed.
