This appeal if from the denial of a petition for mandamus filed by Dr. Vance D. Rogers, relator-appellant. The problem involved is the constitutionality of sections 85-701 through 85-721, R.S.Supp., 1972, hereinafter referred to as L.B. 1171, relating to education in independent institutions of higher education.
