This is an appeal from a conviction for murder with malice aforethought wherein the punishment was assessed by the jury at fifty (50) years.

The sufficiency of the evidence is not challenged. Suffice it to say the State's evidence reflects that the appellant and Marta Dodson, both prostitutes, went to the deceased's apartment in Dallas on the morning of June 29, 1972, with the intent to rob him, and that while there...
