Defendant assigns as error the failure of the court to grant his timely made motion for nonsuit. The evidence, viewed in the light most favorable to the State, tended to show: On 24 January 1973 Mrs. Alta Skinner left her apartment at 2836 Chapel Hill Road, Durham, at 7:30 p. m. and returned at about 10:00 or 10:30 p. m.
