No. 74-583.

306 So.2d 590 (1974)

Raymond F. FAYERWEATHER, Appellant, v. The STATE of Florida, Appellee.

District Court of Appeal of Florida, Third District.

November 12, 1974.

Attorney(s) appearing for the Case

Phillip A. Hubbart, Public Defender, and Roy S. Wood, Jr., Asst. Public Defender, for appellant.

Robert L. Shevin, Atty. Gen., and Joel D. Rosenblatt, Asst. Atty. Gen., for appellee.

Before BARKDULL, C.J., and PEARSON and HENDRY, JJ.

PER CURIAM.

The order under review is the denial of relief sought by a petition for writ of habeas corpus.

This denial is affirmed, without prejudice to the appellant filing a motion pursuant to Rule 3.850 CrPR in the trial court, contesting the legality of his sentencing, notwithstanding the prior decision of this court reported in Fayerweather v. State, Fla.App. 1972, 258 So.2d 522.
