The appellant, Catalina, Inc. was the tenant of the appellee Biscayne Northeast Corporation of Florida. The tenant moved out of the leased premises before the expiration of the term but before doing so tendered a sublease at a higher rent to the landlord. The sublease was rejected by the landlord, who then offered the premises at a higher rate and subsequently rented at that rate.
