Appellant, Herman Ray Neely, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County, Case No. CRM-74-380, of the crime of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor, in violation of 47 O.S., 11-902.
