Roger Dale Russell, hereinafter referred to as defendant, was charged and tried for the offense of Murder and convicted for the lesser and included offense of Manslaughter in the First Degree, under the provisions of 21 O.S. 1971, § 711, in the District Court, Tillman County, Case No. CRF-72-55 (this action was prosecuted before the effective date of current homicide statutes 21 O.S....
