Richard J. McNeely instituted this action for a declaratory judgment interpreting the last will and testament of his deceased aunt, Mrs. Willie M. Garrett, and decreeing that plaintiff has the right to receive as a special legacy, in full ownership, certain items of real and personal property left by the testatrix.
