This is an appeal from a judgment of the Municipal Court granting plaintiff compensation for improvements constructed by mistake on land belonging to defendant. The Court below found that defendant had no actual notice that the imrovement (a cistern) was being constructed by plaintiff and attempted to stop the construction when he learned of it.
