Defendant has moved to quash this indictment on the ground of variance from the complaint before the magistrate. The Commonwealth opposes the motion.

On April 29, 1974, a patrolman of the Ohioville Borough Police Department made and executed a complaint before George L. Shaffer, a district magistrate, which says:

"(2) The acts committed by the accused were: RESISTING ARREST...
