The defendants were severally indicted on charges of unarmed robbery of one Ater and of assault and battery by means of a dangerous weapon (a shoe) on Ater. They were tried before a jury and were convicted and sentenced. The cases are here on bills of exceptions, each alleging error in the judge's charge.
