IN RE LOCKLEAR

No. 7416DC218.

205 S.E.2d 543 (1974)

21 N.C. App. 715

In the Matter of Janice Lee LOCKLEAR, Juvenile.

Court of Appeals of North Carolina.

June 5, 1974.

Attorney(s) appearing for the Case

Atty. Gen. Robert Morgan by Associate Atty. Robert R. Reilly, Raleigh, for the State, appellee.

Moses & Diehl by Philip A. Diehl, Raeford, for appellant.

CARSON, Judge.

The adjudication that the juvenile was undisciplined arose from the same factual situation and at the same hearing as that decided in the case of In re McMillan, N. C.App., 205 S.E.2d 541, decided contemporaneously with this decision. For the same reasons as those set out in In re McMillan, the order appealed from, being unsupported by the evidence, must be vacated.
